Investigative journalist Derrick Broze has uploaded a new interview with attorney Michael Connett, the legal counsel for the Fluoride Action Network (FAN) in our lawsuit against the U.S. Environmental Protection Agency (EPA). Broze has provided excellent in-depth coverage of our lawsuit since the start of the first trial in 2020. In the 33-minute video, Connett explains:

• The recent ruling by the US Court of Appeals for the 9th Circuit;
• What made the appellate court’s ruling most concerning from an attorney’s perspective;
• The potential next steps for the plaintiffs; 
• The EPA’s contradictory actions on water fluoridation, and;
• His response to a new study claiming to prove that fluoridation doesn’t lower IQ.

With all of the misinformation being reported by the mainstream media and by proponents of fluoridation since the appellate court’s ruling, it’s important to re-emphasize something that Connett says during the interview. He points out that the ruling did not change or even challenge the facts and findings of the district court that water fluoridation poses an “unreasonable risk to human health.”  The case was remanded on procedural grounds, which doesn’t undo or overturn the factual findings and science presented at trial. In fact, according to the appellate court, the error the district court judge made was waiting for and considering the latest evidence instead of ending the trial in 2020 before the publication of the National Toxicology Program’s review of fluoride neurotoxicity.
