Tolerance in spearmint and peppermint oil. Final
Rule.
This regulation establishes a tolerance of 2.0 ppm for residues
of trifluralin in spearmint and peppermint
oil under the Federal Food, Drug, and Cosmetic Act (FFDCA),
as amended by the Food Quality Protection Act of 1996 (FQPA).
The FQPA substantially rewrote section 408 of FFDCA. As a result,
the revisions made it necessary, once again, to establish
tolerances for mint oils that had previously been deemed unnecessary.
In the Federal Register of November 24, 2004, EPA on its own
initiative, under section 408(e) of FFDCA, 21
U.S.C. 346a(e), announced a proposal to establish a permanent
tolerance for residues of the herbicide trifluralin in spearmint
and peppermint oil at 2.0 ppm. The proposal
included a summary of the exposure assessment prepared by the
Agency.

This document proposes to establish a tolerance for residues
of trifluralin in mint oil under
the Federal Food, Drug, and Cosmetic
Act (FFDCA), as amended by the Food Quality Protection Act
of 1996 (FQPA). The amendment substantially rewrote section
408 of FFDCA. As a result, the revisions made it necessary,
once again, to establish tolerances on certain commodities,
such as mint oils, that had previously
been deemed unnecessary.
• The Agency concluded that trifluralin is a ``Group
C'' (limited evidence of carcinogenicity) carcinogen with
a Q1* of 0.0077 (mg/kg/day); (Based
on male rat thyroid follicular cell tumors combined).
Note from FAN:
-- EPA included a lot of studies in this Notice. However,
no study that found thryoid tumors was presented.
-- There is no discussion of endocrine
disruptors, or the need to include Trifluralin in a study
for endocrine disruption. in this Notice.
• Section 408(b)(2)(A)(i) of FFDCA allows EPA to establish
a tolerance (the legal limit for a pesticide chemical residue
in or on a
food) only if EPA determines that the tolerance is ``safe.''
Section 408(b)(2)(A)(ii) of FFDCA defines ``safe'' to mean
that ``there is a
reasonable certainty that no harm will result from aggregate
exposure to the pesticide chemical residue, including all
anticipated dietary exposures and all other exposures for
which there is reliable information.'' This
includes exposure through drinking water and in residential
settings, but does not include occupational exposure.
• Section 408(b)(2)(C) of FFDCA requires EPA to give
special consideration to exposure of infants and children
to the pesticide
chemical residue in establishing a tolerance and to ``ensure
that there is a reasonable certainty that no harm will result
to infants and children from aggregate exposure to the pesticide
chemical residue....''. Note from FAN:
EPA
did not include any "safety factor" for children
in setting this tolerance.
• In a rat metabolism study of
urinary metabolites conducted in 1989, "A minimum of
20-30 non-conjugated metabolites and an additional 10-20 conjugated
metabolites were present in the urine" - Information
on the percentage of the administered dose excreted in the
urine was not provided. Note from FAN:
"EPA has not made a common mechanism of toxicity finding
as to trifluralin and any other substances and does not appear
to produce a toxic metabolite produced by other substances."

Pursuant
to a January 22, 2004 Court Order, EPA has developed a point
of sale notification regarding urban use pesticide products
containing any of seven active ingredients. As further directed
by the Court, EPA is hereby notifying retailers of lawn and
garden pesticides in urban areas of California, Oregon and
Washington through which ``salmon supporting
waters'' pass that they are to make the point of sale
notification whenever products containing these seven active
ingredients are sold. The Court's Order also requires defendant-intervenors
(groups representing pesticide manufacturers, growers and
other pesticide users) to distribute the point of sale notifications
to sales outlets in these urban areas on or before April 5,
2004. |

The
Order (with some exceptions) enjoins, vacates and sets aside
EPA's authorization of certain pesticides' uses within 20
yards for ground applications and 100 yards for aerial applications,
adjacent to salmon supporting waters in California, Oregon
and Washington, effectively establishing buffer zones around
those waters.
This
order applies to 38 pesticides, including the fluoridated
Diflubenzuron, Oxyfluorfen, Trifluralin.
