Closing Statements Scheduled For NEXT WEEK

A major scheduling change occurred at the close of yesterday’s proceedings. Closing statements from both the plaintiffs (FAN) and defendants (EPA) will now take place on Tuesday, February 20th at 9:30 a.m. (Pacific) / 12:30 (Eastern). The judge wanted time to watch deposition videos, look over evidence, and prepare a series of key questions for attorneys that he will ask on February 20th. That hearing will also be streamed live for the public on Zoom and will be recorded for future publication on the court’s website.

So, if there’s only one court session that you watch, next Tuesday’s should be the one! Attorneys will spend somewhere around 40-60 minutes each summarizing their key arguments and evidence presented during the trial, bringing everything together into one cohesive presentation.

The trial continues today with further testimony from one of the U.S. Environmental Protection Agency’s expert witnesses, Stanley Barone, Jr., Ph.D. at 8:30 a.m. (Pacific) / 11:30 a.m. (Eastern). Completion of Barone’s testimony will be followed by an important cross-examination by FAN’s attorney, Michael Connett. Attorneys plan to wrap up witness testimony today and expect there to be no further proceedings until next Tuesday’s closing statements.
